1. These Terms and Conditions set out the rules for renting the house in Masuria known as “Omulove Zacisze” (hereinafter referred to as the Property or the Subject of the Agreement).
2. The operator managing the rental of the Property is ANYWAY Sp. z o.o., ul. Modlińska 129/u10, 03-186 Warsaw, Tax Identification Number (NIP): 524-294-99-11 (hereinafter referred to as the “Operator”).
3. These Terms and Conditions form an integral part of the Rental Agreement.
4. Making a reservation in any form constitutes acceptance of these Property Terms and Conditions.
5. The Tenant makes a preliminary reservation by telephone, through the website, or by email. When making a preliminary reservation, the dates of the stay and the number of guests must be specified. A preliminary reservation is made after the availability of the house for the requested dates has been confirmed and an unambiguous verbal or written intention to rent has been expressed. The preliminary reservation remains valid for 48 hours from the time the above arrangements are made.
6. For standard reservations, i.e. those made fewer than 180 days before the planned arrival date, the deposit is 50% of the total cost of the stay. The remaining balance must be paid no later than 30 days before the planned arrival date.
7. For reservations made well in advance, i.e. 180 days or more before the planned arrival date, payment may be divided into the following installments:
7.a) 20% of the cost of the stay — payable within 48 hours of making the reservation as a deposit confirming the dates;
7.b) 30% of the cost of the stay — payable no later than 100 days before the planned arrival date;
7.c) the remaining 50% of the cost of the stay — payable no later than 30 days before the planned arrival date;
7.d) a refundable security deposit of PLN 2,000 — payable no later than 7 days before the planned arrival date to the bank account specified by the Landlord.
8. The deposit and subsequent payment installments should be paid directly into the Landlord's bank account: 44 1090 1841 0000 0001 6105 5264.

10. Failure to pay the deposit within 48 hours of making the preliminary reservation will result in the automatic cancellation of the preliminary reservation, without the Landlord being required to make any additional declarations.
11. Failure to pay any subsequent payment installment by the specified deadline may result in the cancellation of the reservation due to the Tenant's fault. In such a case, any amounts paid to date are non-refundable unless the Landlord succeeds in rebooking the cancelled dates to other Guests.
12. The period of use of the Property begins at 4:00 p.m. on the first day of the Rental and ends at 10:00 a.m. on the last day of the Rental, unless the Parties agree otherwise in writing.
13. For reservations made less than 30 days before the check-in date, the Tenant is required to pay 100% of the cost of the stay and the security deposit for the reservation to be confirmed as final. The security deposit is not part of the cost of the stay.
14. If the Tenant cancels the stay, the following cancellation rules apply:
14.a) Cancellation made at least 180 days before the scheduled arrival date—the amounts paid are refundable, provided that the Landlord deducts an administrative fee of PLN 1,000 for processing the reservation, removing the dates from availability, and performing administrative activities related to the cancellation. Alternatively, with the Landlord's consent, the Tenant may change the dates of the stay once to other available dates in the same or following season without deduction of the administrative fee.
14.b) Cancellation made between 179 and 101 days before the scheduled arrival date—the deposit, equal to 20% of the cost of the stay, is non-refundable. With the Landlord's consent, the deposit may be applied to other available dates.
14.c) Cancellation made between 100 and 31 days before the scheduled arrival date—the amounts paid, totaling 50% of the cost of the stay, are non-refundable. With the Landlord's consent, the amounts paid may be applied to other available dates.
14.d) Cancellation made less than 30 days before the scheduled arrival date—the reservation is non-refundable, and the entire amount paid for the stay, i.e. 100% of the cost of the stay, is retained by the Landlord.
14.e) Irrespective of the cancellation rules specified above, if the Landlord succeeds in rebooking the cancelled dates to other Guests, the amounts paid by the Tenant may be refunded in whole or in part, in proportion to the amount recovered from rebooking those dates. The refund does not include the administrative fee referred to in clause 14.a), if applicable.
14.f) The refundable security deposit is not part of the cost of the stay. If the reservation is cancelled before the stay begins, the security deposit, if already paid, is refundable in full.
14.g) If the Tenant fails to arrive on the first day of the stay, arrives later, or shortens the stay for reasons attributable to the Tenant, the Landlord will not refund any amount for the unused portion of the stay.
15. The dates of the stay may be changed only by individual arrangement with the Landlord and subject to availability. A change of dates may result in a change in the cost of the stay if the new dates fall within a different pricing season, are subject to a different rate, or the current price list has changed. If more expensive dates are selected, the Tenant is required to pay the difference. If less expensive dates are selected, the final reservation amount will be reduced accordingly.
16. A security deposit of PLN 2,000 is payable by bank transfer no later than 7 days before arrival. The security deposit serves as security against damage, destruction, damage to equipment, violation of the rules of stay, or the need to perform additional servicing after the Tenant's stay.
17. The security deposit is not part of the cost of the stay and cannot be credited toward payment for the stay. The security deposit will be returned to the Tenant within 7 days of check-out, provided that the Property, its equipment, the building, and the grounds belonging to the house are not damaged or in a worse condition than on the date of the Tenant's arrival.
18. The Tenant should report any damage, defects, or destruction to the Landlord immediately upon noticing or causing them.
19. The maximum number of Guests permitted to stay at the Property is 15 people. The minimum reservation period is 2 nights unless the offer for the relevant dates states otherwise.
20. Only persons declared at the time of reservation or approved by the Landlord before arrival may stay at the Property. Exceeding the agreed number of Guests without the Landlord's consent may result in an additional fee or immediate termination of the agreement.
21. The Tenant bears full and exclusive responsibility for all persons staying with them at the Property, including children and animals.
22. The Tenant and all declared persons staying at the Property are required to comply with the House Rules and fire safety regulations.
Making the Property available to third parties is prohibited.
Cancellation of part of the stay, late arrival, or early departure from the Property for reasons attributable to the Tenant do not entitle the Tenant to a refund of any amounts paid.
Tenants are required to maintain and return the holiday home in the condition it was in on the day of arrival, allowing for normal wear and tear resulting from proper use of the Property.
Tenants are financially liable for any damage to or destruction of furnishings and technical equipment caused by them or by persons visiting them during their stay.
If any furnishings or property in the holiday home are damaged, Tenants are requested to inform the Landlord so that they can be repaired or replaced. Financial compensation for the repair or replacement will be calculated based on the repair costs and must be paid no later than on the day of departure; if this is not possible, the repair cost will be deducted from the security deposit.
As parents or guardians are responsible for the safety of children and the consequences of their actions, they are requested to supervise children at all times.
The Landlord is not liable for any interruptions in the supply of water, electricity, or other utilities resulting from circumstances attributable to external providers.
Tenants are requested to familiarize themselves with the location of the fire extinguishers in the holiday home and the instructions for their use.
Due to fire safety requirements, electrically or gas-powered devices or appliances that are not part of the home's equipment and may pose a fire hazard, such as gas burners, electric heating elements, or gas or electric heaters, must not be used on the Property. Bringing flammable or explosive materials or materials with an unpleasant odor into the home is also prohibited.
Tenants may be charged additional costs for vandalism of the holiday home, unauthorized use of fire extinguishers, and any resulting consequences, including the need to replace equipment or perform additional maintenance work.
The Landlord is not responsible for items left in the holiday home.
The house is heated by underfloor heating. Guests may adjust the temperature in each room according to their individual preferences; however, during the winter, the temperature must not be set higher than 24°C.
On the day of arrival, the Tenant is required to present an identity document to confirm their identity and provide the details of the other Guests.
Use of the freestanding wood-burning stove in the living room:
Before lighting a fire, make sure that the chimney flue is open and unobstructed.
Remove all flammable items from the area around the stove.
Use the available firewood and kindling located in the designated place on the Property.
Do not use any flammable liquids, such as gasoline or alcohol, to light the fireplace.
The fire should be lit gradually, starting with small pieces of wood and then adding larger ones.
Do not leave the fireplace unattended while the fire is burning.
Children and animals must be kept away from the fireplace.
Ash must only be removed once it is cold and disposed of in the designated place.
Any damage to or problems with the fireplace must be reported to the owner or the Omulove Zacisze staff.
Do not burn plastic, paper, rubbish, or any other materials that are not intended for use in the fireplace.
Do not use the fireplace while under the influence of alcohol or other intoxicating substances.
Do not heat the fireplace to extremely high temperatures, as this may damage the cast iron in the fireplace insert.
Animals belonging to the Tenant may stay on the Property after obtaining the Landlord's consent.. The Tenant is obliged to clean up after the animals and take care of them in such a way that their stay in the Property does not lead to deterioration of its condition, the condition of its equipment or is not a nuisance to the surroundings.
38. Rules for animals staying at Omulove Zacisze:
Please maintain cleanliness and clean up after your animals both inside the house and throughout the entire premises.
Animals must remain under their owner's constant supervision and must not disturb the neighbors.
Please take care of the house furnishings to prevent damage caused by animals.
The animal's owner is liable for any damage or destruction caused by the animal. If damage occurs, the owner will be charged for the repair or replacement of the damaged property.
The Omulove Zacisze premises are fenced, but the fence is not completely secure, so please keep an eye on your animals.
39. Use of water sports equipment:
The use of SUP boards and the pedal boat is permitted exclusively for guests of Omulove Zacisze.
The equipment may only be used between 8:00 a.m. and 8:00 p.m.
Users of SUP boards and the pedal boat must wear life jackets at all times while on the water.
Do not use the equipment during a storm, strong winds, or other adverse weather conditions.
It is recommended that you remain within sight of other people while on the water.
Using the equipment while under the influence of alcohol or other intoxicating substances is prohibited.
Children may use the water sports equipment only under the constant supervision of adults.
The equipment must be used only for its intended purpose.
SUP boards must not be overloaded. The maximum load for a SUP board is 150 kg.
Only mount a SUP board when the water is sufficiently deep in relation to the equipment to prevent it from being damaged by the bottom of the body of water.
After use, the equipment must be dried and stored in the designated place.
Users are liable for damage caused by the improper use of the water sports equipment available at Zacisze.
If the equipment is damaged, the user is required to cover the cost of its repair or replacement.
Users should avoid sudden movements that could cause the water sports equipment to capsize.
Exercise caution when approaching other people using the water and natural obstacles, such as the bottom, rocks, or aquatic vegetation.
After using the water sports equipment, it must be returned undamaged to the designated place on the Property.
Please do not leave SUP boards in the sun.
40. Use of the dock belonging to Omulove Zacisze:
The dock is private and intended exclusively for guests of the house.
Use of the dock is at your own risk.
The dock is located in relatively deep water: the water is approximately 80 cm deep at its beginning and approximately 3.5–4 m deep at its end.
40.4. Children may remain on the pier only under the constant supervision of adults.
40.5. Running on the pier, jumping into the water in areas not designated for this purpose, entering the pier during adverse weather conditions, and consuming alcohol on the pier in a manner that endangers safety are prohibited.
40.6. The pier is unsupervised and does not serve as a designated swimming area.
40.7. Use of the pier after dark is permitted only with particular caution.
40.8. Fishing is permitted only in a manner that does not inconvenience other Guests.
40.9. Damaging any parts of the pier, nailing, tying, or installing additional items without the owner's consent, and leaving behind rubbish or equipment are prohibited.
40.10. Any damage to the pier that is noticed must be reported immediately to the owner or the property Operator.
41. Rules for using the whirlpool hot tub:
41.1. The whirlpool hot tub is intended exclusively for Guests of the property and may only be used for its intended purpose and in accordance with these rules.
41.2. Use of the hot tub is at the user's own risk. Children may remain in the hot tub only under the constant supervision of adults.
41.3. Before entering the tub, users must shower, remove their footwear, and refrain from using oils, bath foams, cosmetics, or foaming substances. If the Operator determines that this prohibition has been violated, the Renter may be charged the costs associated with servicing the whirlpool hot tub.
41.4. Use of the hot tub while under the influence of alcohol or other intoxicating substances, as well as in the event of feeling unwell, heart disease, a high-risk pregnancy, or other medical contraindications, is prohibited.
41.5. Consuming beverages, including alcohol, inside the hot tub is prohibited. This applies to all beverages, including those in sealed containers.
41.6. Spilling beverages into the hot tub or discovering beverages in the water will necessitate replacing the water, cleaning, and preparing the hot tub for use again. In such a case, PLN 1,000 may be deducted from the security deposit to cover the costs of water replacement, chemicals, energy, and servicing.
41.7. The hot tub cover is intended solely to maintain the water temperature and protect the tub and is not designed to support people or objects.
41.8. Sitting, standing, or lying on the cover, leaning against the folded cover, placing any objects on it, or moving the cover in a manner that could damage it is prohibited.
41.9. The cover must be removed gently and placed in its entirety in the designated location, in accordance with the instructions. The cover must be replaced after each use of the hot tub.
41.10. The thermal cover is a particularly delicate and expensive component. Damage to it, including in particular cracks, breakage, deformation, loss of watertightness, or water absorption, may prevent further safe use of the hot tub.
41.11. Damage to the hot tub's thermal cover may result in the costs of repair or replacement being deducted from the security deposit, up to the full amount of the deposit.
41.12. In the event of other damage to the hot tub or its components, Guests are financially liable for the costs of repair or replacement up to the amount of the security deposit collected.
41.13. Any irregularities or damage that are noticed must be reported immediately to the owner or the property Operator.
41.14. Please maintain the hot tub temperature between 36°C and 39°C. Suddenly lowering the setting will not cool the water immediately and may make it more difficult to heat it again. Please also do not leave the cover open in order to cool the water.
41.15. Please do not change the hot tub's technical settings. The hot tub has been properly configured and prepared for safe use. Unauthorized changes may disrupt its operation, make it difficult to maintain the temperature, or require reconfiguration.
42. Children's outdoor pool:
42.1. The children's outdoor pool is available seasonally during the summer holiday period, depending on weather conditions and the technical feasibility of setting it up.
42.2. The pool is approximately 3 m in diameter and approximately 60 cm deep. It is intended exclusively for recreational use by children under the constant supervision of adults.
42.3. Children may use the pool only under the direct and constant supervision of their guardians.
42.4. Adults must remain by the pool at all times while it is being used by children.
42.5. Use of the pool is at the risk and responsibility of the Guests or the children's guardians.
42.6. The property owner is not liable for the consequences of using the pool contrary to the Rules and Regulations or without adult supervision.
42.7. Before entering the pool, please rinse any sand, grass, and dirt from your body. This helps keep the water cleaner and reduces the need to replace it.
42.8. The pool water is chlorinated. Please do not add any chemicals, cosmetics, oils, bath foams, or other substances to it.
42.9. Dogs and other animals are not permitted to use the pool.
42.10. Food, drinks, sand, stones, toys with sharp components, or other objects that may contaminate or damage the pool must not be thrown into the pool.
42.11. The pool should not be used during a thunderstorm, strong winds, when feeling unwell, or in the presence of visible skin irritation.
42.12. Jumping into the pool, sitting on its edges, climbing its walls, and abruptly tilting the structure are prohibited.
42.13. After using the pool, please place the protective cover over it. This will help reduce the amount of insects, leaves, grass, and other debris falling into the water.
42.14. If you notice contaminated water, damage to the pool, or any other irregularities, please contact the owner or operator of the property immediately.
42.15. If the pool is damaged or the water needs to be replaced due to improper use, Guests may be charged for the cost of repairs, water replacement, or preparing the pool for use again.
43. Rules for using the fire pit:
A bonfire may only be lit in the designated area prepared for this purpose by the owner of the Property.
Guests light a bonfire at their own risk and must comply with safety rules and applicable fire safety regulations.
Children may remain near the bonfire only under adult supervision.
Only wood intended for the bonfire and provided or designated by the owner may be burned in it. Please do not use firewood intended for the fireplace to light the bonfire.
It is prohibited to burn construction timber, furniture wood, varnished, treated or painted wood, as well as branches, plant waste, rubbish, cardboard, plastics or any other materials.
It is prohibited to move the fire outside the designated area.
It is prohibited to light a bonfire during strong winds, drought or conditions posing a fire hazard.
It is prohibited to leave the bonfire unattended, even for a short time.
After using the bonfire, the fire must be completely extinguished, it must be ensured that the embers have been doused with water and pose no danger, and the bonfire area must be left clean.
Guests shall be financially liable for any damage resulting from improper use of the bonfire.
Vehicles may be parked on the Property only in the designated area, i.e. beyond the entrance gate to the Property. A maximum of six passenger cars may be parked in the part of the Property designated for parking. The Lessor shall not be liable for the loss of or damage to vehicles or any property left inside them.
The Lessor shall not be liable for the loss of or damage to Guests' money, securities, valuables or other tangible property.
The rental price includes:
the stay at the Property during the period specified in the Agreement;
the cost of utilities, in particular electricity, water, sewage disposal and waste collection;
the use of the Property's furnishings and equipment.
The Tenant is obliged to:
use the barbecue in the designated area; the barbecue may not be used inside the house;
use water sports equipment for its intended purpose and in accordance with the instructions;
keep the pedestrian gate and entrance gate closed;
protect the Property and its furnishings and equipment against damage or theft; for this purpose, when leaving the Property, the Tenant should close the windows and lock the entrance door with the key provided; the Property is monitored and protected by an external entity; the surveillance footage is reviewed by the Property Operator only in justified cases; the surveillance system covers only the outdoor area of the Property and does not cover the interior of the house or Guests' private areas;
use the Property and its furnishings and equipment for their intended purpose, in a manner that does not violate accepted standards of conduct or good neighbourly relations and that is appropriate for an area designated as a quiet zone;
refrain from charging electric cars on the Property; the house is not designed for such power consumption, which may overload the electrical system and pose a safety hazard; violation of this prohibition may result in the Tenant being charged additional costs related to the operation of the electrical system and may entail consequences arising from a breach of safety requirements;
refrain from washing cars on the Property; washing vehicles may contaminate the soil and water with chemicals that could harm the environment and the infrastructure of the premises;
refrain from making the Property available to third parties wishing to stay overnight on the premises in tents or caravans.
The Tenant is neither obliged nor authorised to maintain the garden.
The Tenant is not authorised to carry out any repairs to the Property or its furnishings and equipment. Any damage or defects must be reported to the Lessor immediately upon discovery. Where possible, the Tenant should photograph the defect or damage and then send the photograph to the Lessor's contact number.
Smoking tobacco products and electronic cigarettes is strictly prohibited at the Property. Violation of this prohibition may result in the Tenant being charged a fee of PLN 1,000 for additional cleaning, ozone treatment and removal of the smell of smoke.
The Tenant is obliged to vacate the Property in accordance with the check-out rules available in the house and provided before or during the stay. These rules include, in particular, leaving the house reasonably tidy, taking rubbish to the designated location, removing the Tenant's own food from the refrigerators, returning used equipment and furnishings to their proper places, and securing the house before leaving the Property.
Failure to comply with the check-out rules, in particular leaving the Property in a condition requiring cleaning beyond the standard scope or additional work by the staff, may result in a fee of PLN 1,000 being deducted from the security deposit for additional cleaning and preparation of the house for subsequent Guests.
53. The Landlord reserves the right to require the Tenant or persons staying with the Tenant at the Property to leave the Property in the event of a serious breach of the Regulations, safety rules, or the peace and order of the neighbourhood.
54. In matters not regulated by these Regulations, the relevant provisions of the Civil Code shall apply. In the event of a dispute, the Parties shall seek to resolve the matter amicably. If no agreement can be reached, the dispute shall be resolved by the court having jurisdiction over the location of the holiday home.
55.If the actual number of persons staying at the Property exceeds the number declared at the time of booking or accepted by the Landlord before arrival, the Landlord shall have the right to charge an additional fee for each undeclared person. The amount due may be deducted from the security deposit. The above does not exclude the Landlord's right to terminate the agreement with immediate effect if the maximum number of Guests is exceeded or in the event of a serious breach of the Regulations.
56. The Tenant is obliged to read these Regulations before the start of the stay. Making a booking and paying the deposit or the full rental price constitutes acceptance of the Regulations and conclusion of a rental agreement under the terms specified herein.
57. These Regulations shall be effective from 1 July 2026.
